Parental authorisation template

What this document is for

When a minor is recognisable in a surf clip, publishing it requires the written agreement of both parents — more precisely, of both holders of parental authority.

Article 372-1 of the French Civil Code (Code civil), as amended by law no. 2024-120 of 19 February 2024 on safeguarding respect for children's image rights, provides that parents jointly protect their minor child's image rights. Publishing a child's image publicly is not a routine act: the agreement of one parent alone is not enough.

This template is a service provided to organisers and videographers. It is not a platform mechanism:

  • Onde Interactive does not collect this document;
  • Onde Interactive does not verify it and does not keep it;
  • no technical barrier blocks the publication of a clip for want of an authorisation.

What is required is the warranty you give when uploading a clip, under article 5.1 of the terms of use. The written authorisation is the evidence that protects you if that warranty is called into question. Keep it: it will be asked of you, not of the platform.

Are you a parent who does not want your child's image published? You have nothing to do in advance, and you do not have to give reasons for your request: write to contact@ondeinteractive.com or use the contact page (reason “Removal request”). The clip is removed within 72 hours.

This authorisation is given free of charge and for non-commercial purposes, excluding any advertising use, any misuse outside the sporting context and any use harming the child's dignity or reputation.

4. Territory and duration

Once that period expires, the organiser ceases all further publication.

5. Revocation — how to go back on this authorisation

This authorisation may be revoked at any time, by either holder of parental authority, or by the child themselves, without having to give reasons.

To revoke:

Revocation takes effect for the future: materials already printed or copies already circulated by third parties cannot always be recalled, but all new publication stops.

6. Personal data

The information collected in this document is processed by the organiser for the sole purpose of evidencing this authorisation. It is kept for the duration of the authorisation plus the applicable limitation period, then deleted. The rights of access, rectification, erasure and objection are exercised with the organiser. Onde Interactive is not a recipient of this document.

And what about you?

This part is addressed to the child. Article 372-1, second paragraph, of the French Civil Code (Code civil) requires parents to involve the child in decisions about their image rights, according to their age and level of maturity. Your opinion counts, and it counts more and more as you grow up.

Here is what you are being asked, plainly:

  • Your parents are allowing a video of you surfing to be put online on Onde Interactive.
  • Other people signed up to the site will be able to see this video, and they can vote for it in a contest.
  • You don't have to say yes. If you don't want to, tell your parents: they must not give the authorisation.
  • And if you change your mind later, that's fine. Even in six months, even in two years. You ask your parents to write to contact@ondeinteractive.com, or you write yourself. The video is taken down within three days at most.
  • You don't have to explain why. It's your image, and it's your decision.
