Terms of Sale
Version of 22 July 2026.
1. Purpose and scope
These terms of sale (hereinafter the "Terms of Sale") govern the sale of the paid services of the Onde Interactive platform, a trading name of Yves Léon EI.
They apply to every customer, whether they are:
- an individual acting for non-professional purposes — amateur videographer, rider, parent, enthusiast: they are then a consumer within the meaning of the preliminary article of the French Consumer Code (Code de la consommation), and benefit from all the protections provided for in articles 6 to 9 of these Terms of Sale;
- a professional — surf school, surf camp, club, association, professional videographer: the provisions specific to business-to-business relationships are set out in article 12.
These Terms of Sale are drafted primarily for consumers. Where there is doubt as to the customer's status, the most protective provisions apply.
The Terms of Sale supplement the terms of use (the "Terms") and prevail over them in all matters relating to prices, ordering, payment, the right of withdrawal and guarantees. Free use of the platform — creating an account, taking part as a judge, submitting a clip — remains governed by the Terms alone.

The postal address, email address and telephone number above are those to which the customer may send any complaint.
3. Services offered and prices
Onde Interactive sells two services, both paid for in a single payment. There is no subscription, no tacit renewal, no open-ended contract.

Prices are expressed in euros, all taxes included. VAT not applicable, art. 293 B of the French General Tax Code (Code général des impôts) — the seller falls under the VAT-exempt small business scheme; no VAT is due or recoverable.
No additional charge is invoiced: no administration fee, no set-up fee, no payment fee. The price shown on the payment button is the total price due.
Creating an account, creating a competition in draft state, taking part as a judge and submitting a clip are free of charge.
Onde Interactive may change its prices at any time. The applicable price is the one displayed at the time of the order.
What you need in order to use the service. Onde Interactive is an online service: an up-to-date web browser and an internet connection are all that is required, with no installation and no special hardware. The service works on desktop, tablet and phone. Clips are uploaded in common video formats and can be returned to you as the original file; invoices are provided in PDF. The service depends on no other third-party software or subscription that you would have to take out.
4. Ordering
4.1 Process
The order is placed entirely online:
- the customer selects the service from their area;
- a summary screen presents, before any payment: the service, its total price including tax, the statement "VAT not applicable, art. 293 B of the French General Tax Code (Code général des impôts)", the identity of the seller, and the information relating to the right of withdrawal;
- the customer may, at this stage, check the details of their order and its total price, and correct any errors by going back to the previous screen, before any validation;
- the customer ticks the box, not pre-ticked, by which they request immediate performance of the service and waive their right of withdrawal (article 6);
- the customer confirms their order by clicking a button bearing the words "order with obligation to pay", in accordance with article L. 221-14 of the French Consumer Code (Code de la consommation);
- they are redirected to Stripe's secure payment page;
- the order is definitively formed once payment is collected.
This process — a summary that can be checked and corrected, then explicit confirmation — constitutes the double-click required by article 1127-2 of the French Civil Code (Code civil).
4.2 Confirmation
The customer receives, on a durable medium (email), within a reasonable time after the conclusion of the contract and at the latest when performance begins:
- confirmation of the contract and its summary;
- the confirmation of their express consent to immediate performance and of their waiver of the right of withdrawal (see article 6);
- the corresponding invoice.
4.3 Complimentary services
Onde Interactive may offer a service free of charge (crew activated at no cost, competition published at no cost), in particular as part of a first competition offered to a new crew. A complimentary service is not a contract for consideration: no price is due, no waiver of the right of withdrawal is requested, and articles 5 and 6 of these Terms of Sale do not apply to it.
5. Payment
Payment is made online, in a single payment, by bank card or by any other means offered on the payment page.
Payments are processed by Stripe Payments Europe, Ltd. (The One Building, 1 Grand Canal Street Lower, Dublin 2, Ireland). Onde Interactive never has access to your bank card details, which are collected and processed directly by Stripe. The processing of the associated data is described in the privacy policy.
Performance of the service begins as soon as payment is effectively collected.
6. Immediate performance and right of withdrawal
The two services sold are digital content whose performance begins immediately after payment: crew activation takes effect as soon as payment is collected; for competition publication, collection of the payment immediately unlocks clip uploads, followed by activation and publication of the competition.
This immediate performance only happens at your express request. That request is collected by means of a tick box, not pre-ticked, presented before the order is validated; there is no other purchase path, so ticking that box is necessary in order to reach payment.
By ticking this box, you request immediate performance of the contract and you expressly waive the fourteen (14) day right of withdrawal provided for in article L. 221-18 of the French Consumer Code (Code de la consommation). Article L. 221-28, 13° of the same code allows this waiver for digital content supplied immediately, subject to three conditions: prior express agreement, express waiver, and confirmation on a durable medium — the latter is sent to you by email; the invoice is sent to you separately, also by email.
Consequence: once the box is ticked and payment made, you can no longer withdraw. This deprives you neither of the statutory guarantees of article 7, nor of the right to complain under article 8.
If, however, the confirmation on a durable medium provided for in this article did not reach you, your waiver could be deprived of effect and your right of withdrawal maintained: report it to contact@ondeinteractive.com, which will handle your withdrawal request under articles L. 221-18 et seq. of the French Consumer Code.
7. Statutory guarantees
The consumer customer benefits, independently of any commercial warranty, from the following statutory guarantees:
7.1 Statutory guarantee of conformity of digital content and services
The services sold by Onde Interactive are digital services within the meaning of articles L. 224-25-1 et seq. of the French Consumer Code (Code de la consommation). The seller is required to supply a service that conforms to the contract and is answerable for any lack of conformity existing at the time of supply.
In the event of a lack of conformity, the consumer may require the service to be brought into conformity and, failing that, obtain a price reduction or the termination of the contract, under the conditions of articles L. 224-25-12 to L. 224-25-26 of the French Consumer Code (Code de la consommation).
For a digital service supplied on a one-off basis, the action is time-barred after two years from supply.
7.2 Guarantee against hidden defects
The customer may also rely on the guarantee against hidden defects under the conditions of articles 1641 et seq. of the French Civil Code (Code civil), within two years of discovering the defect.
7.3 Implementation
Any claim under the statutory guarantees is made free of charge, by email to contact@ondeinteractive.com. These guarantees apply whatever the provisions of article 12 of the Terms relating to the limitation of liability, which are unenforceable against the consumer to that extent.
8. Complaints
Any complaint must be sent to contact@ondeinteractive.com, or by post to the address set out in article 2. An acknowledgement of receipt is sent and a reply is provided within fifteen (15) working days.
The customer is invited to contact this service before any recourse to mediation.
9. Consumer mediation
In accordance with articles L. 612-1 and R. 616-1 of the French Consumer Code (Code de la consommation), every consumer has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute with a trader.
After contacting the complaints service referred to in article 8 and failing a response that satisfies you, you may therefore use, free of charge, the consumer mediation procedure offered by:

The European online dispute resolution platform ceased operating on 20 July 2025, following its repeal by Regulation (EU) 2024/3228. Consumers residing in another European Union Member State may consult the list of alternative dispute resolution bodies in their country on the European Commission's website: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.
Recourse to mediation is optional and does not deprive the consumer of their right to bring the matter before the competent court.
10. Personal data
The processing of personal data connected with the order — identity, billing address, purchase history — is described in the privacy policy.
Billing data is retained for ten (10) years under accounting obligations (article L. 123-22 of the French Commercial Code (Code de commerce)).
11. Retrieving your data
You may at any time retrieve your data — account, clips and their metadata, votes, rankings, crew, purchases and invoices — and stop using the service. No provision of these Terms of Sale stands in the way of your taking that data elsewhere.
The request is sent to contact@ondeinteractive.com. The export is free of charge and provided within thirty (30) days: JSON or CSV for structured data, video files and images in their original format, invoices in PDF. Your data remains retrievable for thirty (30) days after your account is closed, and is then deleted under the conditions of the privacy policy.
Not exportable are other users' data, nor the individual scores awarded to your clips by identified judges — only the aggregate averages are provided to you.
12. Provisions specific to professional customers
The provisions of this article apply only to customers acting for professional purposes. They are not enforceable against any consumer.
Payment is due in cash on ordering: no payment term is granted and no discount is applied for early payment. Failing settlement on the due date, the sums due bear, automatically and without prior formal notice, late payment interest at the rate applied by the European Central Bank to its most recent refinancing operation, increased by 10 percentage points, and give rise to a fixed indemnity for recovery costs of forty (40) euros, additional compensation being claimable on production of supporting evidence where the costs incurred exceed that amount (articles L. 441-10 and D. 441-5 of the French Commercial Code (Code de commerce)).
13. Amendments to the Terms of Sale
Onde Interactive may amend these Terms of Sale. The Terms of Sale applicable to an order are those in force at the date of that order, as accepted by the customer at the time of payment. The version date at the top of the document is updated on each amendment and the version history is retained.
14. Applicable law and disputes
These Terms of Sale are governed by French law.
If the customer is a consumer and resides in another Member State of the European Union, they retain the benefit of the mandatory protective provisions of the law of their country of habitual residence (article 6 of Regulation (EC) no. 593/2008 "Rome I"), and may bring proceedings before the courts of their place of residence.
For other customers, any dispute falls within the exclusive jurisdiction of the courts of Paris.
