Terms and Conditions
1. Purpose and Scope
These Terms and Conditions (hereinafter "Terms") govern access to and use of the Onde Interactive platform, a trading name of Yves Léon EI.
Onde Interactive is an online surf video competition platform. It allows videographers and photographers to submit surf clips, which are then evaluated by registered judges through a head-to-head bracket voting system.
By using the platform, you agree to be bound by these Terms in their entirety.
2. Legal Notice
In accordance with French Law n° 2004-575 of 21 June 2004 on Trust in the Digital Economy (LCEN), the following information is provided:

4. Account Registration and Access
4.1 Access Requirements
Access to Onde Interactive requires the creation of a user account. The service is available to individuals aged 18 or over, or to minors with the consent of their legal guardian.
4.2 Registration Obligations
You agree to provide accurate, complete, and up-to-date information when creating your account. You are solely responsible for maintaining the confidentiality of your login credentials.
Onde Interactive reserves the right to refuse or terminate access to any account whose information is found to be inaccurate or fraudulent.
5. User Content — Competition Clips
5.1 Rights Declaration
By submitting a video clip to Onde Interactive, you represent and warrant that:
- you own the rights to the content, or you hold all necessary authorisations to publish it;
- the content does not infringe the rights of any third party, including the right of image of any identifiable person appearing in the video;
- the content does not violate any applicable law, including copyright law, privacy law, or related rights.
5.2 Licence Granted to the Platform
By submitting a clip, you grant Onde Interactive a non-exclusive, royalty-free licence, limited to displaying the content within the competitions organised on the platform.
This licence terminates when you delete the content or when the relevant tournament is definitively closed. You retain full ownership of your content.
5.3 Right of Image and Uploader Responsibility
Under French law (Article 9 of the Civil Code), every person holds an exclusive right over their own image and the use thereof. This right applies even when footage is captured in a public space such as a beach or surf spot.
Publishing a video that features identifiable individuals requires their prior consent, unless those individuals appear as incidental background figures in a collective scene and are not individually singled out.
Surf competition clips typically feature an individual surfer as the primary subject. As the uploader, you bear full responsibility for having obtained the necessary consents from any identifiable person appearing in the video.
Onde Interactive acts as a hosting provider under Article 6 of the French LCEN and is not liable for content it was not made aware of.
5.4 Prohibited Content
The following content is strictly prohibited:
- content that violates human dignity, public order, or common decency;
- defamatory, violent, pornographic, or discriminatory material;
- content that infringes third-party intellectual property rights;
- content containing personal data of third parties without their consent.
Onde Interactive reserves the right to remove any content in breach of these provisions, without prior notice.
6. Notice and Takedown Procedure
Any person whose image appears in a video published on Onde Interactive, or whose rights are infringed by any published content, may request its removal.
6.1 How to Submit a Request
Send your request by email to contact@ondeinteractive.com, including:
- your identity and contact details;
- precise identification of the content (URL or clip title);
- the nature of the alleged infringement (right of image, copyright, etc.).
6.2 Processing Times
Onde Interactive undertakes to process requests relating to the right of image within 72 hours of receiving a complete request. The content will be suspended or removed pending resolution.
For other types of requests, the processing time is 7 business days.
6.3 Hosting Provider Liability Regime
In accordance with Article 6-I-2 of the French LCEN and Article 17 of EU Regulation 2022/2065 (DSA), Onde Interactive cannot be held civilly or criminally liable for hosted content if it had no actual knowledge of the unlawful nature of that content, or if it acted promptly to remove or disable access to it upon gaining such knowledge.
7. Competition Rules
- Participation in tournaments is free of charge, unless otherwise stated for specific events.
- Clip evaluation is carried out by registered judges via the bracket voting system.
- Results are final upon the close of each competition round.
- Onde Interactive reserves the right to disqualify any clip that violates these Terms, without prior notice and without compensation.
- In the event of a dispute over results, the decision of Onde Interactive is final.
8. Accounts and Termination
8.1 Termination by the User
You may delete your account at any time from your account settings, or by sending a request to contact@ondeinteractive.com.
Upon account deletion, your personal data, clips, and voting data will be deleted in accordance with the Privacy Policy.
8.2 Termination by Onde Interactive
Onde Interactive may suspend or terminate an account in the event of a breach of these Terms, fraudulent behaviour, or any other legitimate reason, with prior notice where reasonably possible.
9. Liability and Limitations
9.1 Service Availability
The service is provided "as is". Onde Interactive does not guarantee continuous or uninterrupted availability of the service. Maintenance outages and technical failures may occur.
9.2 User Content
Onde Interactive is not responsible for content submitted by users, acting as a hosting provider under the French LCEN. Liability for user-submitted content rests with the user who submitted it.
9.3 Indirect Damages
Onde Interactive is not liable for indirect damages, loss of revenue, loss of profits, or commercial losses arising from the use of, or inability to use, the service.
10. Platform Intellectual Property
All elements of the Onde Interactive platform — name, logo, interface, design, and features — are the exclusive property of Onde Interactive (Yves Léon EI) and are protected by applicable intellectual property law.
Any unauthorised reproduction, representation, modification, or exploitation of these elements is prohibited.
User-submitted content remains the property of the user; the licence granted to the platform is limited as described in Section 5.2.
11. Governing Law and Jurisdiction
These Terms are governed by French law.
In the event of a dispute relating to their interpretation or performance, and failing amicable resolution within 30 days, the parties submit to the jurisdiction of the competent French courts.
Consumer users may also refer the matter to a consumer mediator in accordance with applicable EU consumer protection law.
